Who is Entitled to Spousal Support?

In Ontario spousal support is not automatically granted. You may be entitled to spousal support if you were either married, lived together as a couple for at least three years or were in a relationship of some permanence for any length of time and have a child together. Entitlement depends on several factors, some of which are: the length of the relationship; the financial means, needs and circumstances of both parties; the roles of each spouse during the relationship; and whether one spouse made sacrifices or contributions that benefited the other, such as staying home to raise children. Each case is determined on its own unique facts which should be closely looked at to determine if a spouse is entitled to spousal support.

How Long is Spousal Support Paid in Ontario?

The Spousal Support Advisory Guidelines provide for calculating the amount and duration of spousal support. The duration of spousal support payments varies based on the specifics of the relationship. Factors such as the length of the relationship or marriage or cohabitation period, age, each spouse’s financial situation, and whether children are involved play a role in determining how long support will be paid. Generally, support can be temporary or indefinite, depending on the circumstances.
